      California DMV Process

      As a California driver, your right to drive is considered a privilege and not a right. Because of this, you are legally bound to not driving while intoxicated.       As a DUI offender, you will have to go through two separate but equally important hearings that include the DMV hearing and the criminal court process. First and foremost, you have 10 days to contact the DMV to request a DMV hearing following the date of your arrest.  Failure to do so will result in your license being automatically suspended after 30 days.

      During the DMV hearing, the hearing officer will only be looking at a few issues to determine whether your license should be suspended.  These issues include whether there was probable cause for the initial stop, whether the driver was over the age of 21 and whether the driver’s blood alcohol content level was over .08%.
