As an out of state driver, you are required to abide by the laws of each state that you are driving in, this includes not driving under the influence of alcohol and or drugs. However, if you are arrested for drunk driving in California, your DUI case will be slightly different than that of a California resident.   Our California DUI Defense Lawyers are here to represent you, even if you are a non-California resident as we believe each person deserve the right to fight for their driving privileges.

If you have been arrested for driving under the influence and your driver’s license has been issued by another state, a California arresting officer cannot take your driver’s license from you as they normally wood for a California resident.  This does not mean, however, that you are in the clear; the DMV will suspend your driving privileges in the state of California which could have an effect on the driver’s license from your state.

How Will a California DUI Affect You?

Due to an agreement between states to share information with one another regarding certain types of traffic violations, called the Interstate Driver’s License Compact (IDLC), you will still be charged for driving under the influence and could be looking at hefty fines, license suspensions as well as potential jail time even on a first time DUI offense.  Currently, all states are members of the IDLC except for Georgia, Massachusetts, Michigan, Wisconsin and Tennessee.
